UAE Notice Period Rules Under the 2021 Labour Law
Under Federal Decree-Law No. 33 of 2021, the legal minimum notice period for most UAE employment contracts is 30 days, and the maximum is 90 days. Your specific notice period should be stated in your employment contract. If it is not mentioned, the legal minimum of 30 days applies. Both the employee and the employer must honour this period β it is a mutual obligation, not optional.
Notice period rules apply regardless of whether the resignation is initiated by the employee or whether the employer is terminating the contract. During the notice period, the employee continues to receive full salary and benefits. The employer cannot change the employment conditions during this time.
What Happens if the Employer Waives the Notice Period
An employer can choose to release an employee immediately by paying compensation in lieu of notice. This means the employee receives their remaining notice-period salary as a lump sum and is free to leave on the day of termination. This is sometimes called “garden leave payment” in UAE employment practice. The employee does not need to work the notice period in this case, and the end-of-service date is the last physical working day.
In my experience, employers sometimes informally ask employees to leave early without formally paying in lieu of notice. This creates a legal grey area and can affect the employee’s final settlement. Always get any early release confirmed in writing before surrendering your access card or company equipment.
Notice Period During Probation
The notice period rules during probation are different. Under the 2021 law, if an employer terminates during probation, 14 days’ written notice is required. If an employee resigns during probation to join another UAE employer, 30 days’ notice is required. If the employee is leaving the UAE entirely, 14 days’ notice applies. These are minimums β your contract may specify longer periods, but cannot specify shorter ones.

Can my employer make me leave immediately without notice pay?
No. Immediate dismissal without notice pay is only permitted in cases of gross misconduct under Article 44 of Federal Decree-Law No. 33 of 2021. Outside these specific grounds, the employer must either allow you to serve your notice period or pay compensation in lieu of it.
What if I breach my notice period in the UAE?
If you leave before completing your notice period without employer agreement, the employer can deduct the equivalent salary for the unserved notice days from your final settlement. They may also file a MOHRE complaint. In practice, most disputes are resolved through negotiation, but the legal liability is real.
Can I take annual leave during my notice period?
You can take annual leave during your notice period only if your employer agrees. The employer is entitled to require you to work throughout your notice period. If you have accrued but unused annual leave at the end of service, you are entitled to payment for those days as part of your final settlement β not as leave taken during notice.
Does the notice period affect my gratuity calculation?
Yes. Your gratuity is calculated up to your last working day, which is the end of your notice period. If your employer waives the notice and pays in lieu, your end-of-service date is the last physical day you worked, not the date the notice period would have ended. Confirm the official end-of-service date in your settlement letter.
